Dec. 11, 2007 Capitol Media Services Judges: Money for English needs mediation PHOENIX — The federal judges weighing whether Arizona has to provide more money to teach English want state legislative leaders to try to reach an out-of-court deal with the parents who are suing them instead. In a court order, the three judges of the 9th U.S. Circuit Court of Appeals said the lawsuit first filed in 1992, "may be an appropriate case for mediation." But the chances of actually resolving the case short of a court order may be slim.

Dec. 5, 2007 Capitol Media Services AZ fulfills U.S. law on English, court told SAN FRANCISCO — The attorney for Republican legislative leaders argued Tuesday that lawmakers have done all that's required to comply with federal laws requiring all students have an opportunity to learn English. In fact, attorney David Cantelme told the 9th U.S. Circuit Court of Appeals, lawmakers even can repeal a 2006 law that is supposed to provide more funds to schools to help teach students not proficient in English.

November 5, 2007 Associated Press Ariz case on English learning approaching high-cost junction  "Lawyers for Republican legislative leaders are asking the 9th U.S. Circuit of Appeals to overturn a trial judge's ruling last March that changes made to Arizona's English Language Learning programs and funding don't satisfy a 1974 federal mandate for equal educational opportunities for English-learning students.The appeal cites changes made under a 2006 law that set the state on a course to require districts to pick and choose among a menu of state-drafted instruction models and get supplemental state funding depend on the district's costs."

October 15, 2007 Capitol Media Services  AZ pursuing appeal over non-English-learner order PHOENIX — State officials will argue before a federal appeals court that a trial judge is illegally ordering them to spend more money to teach English to students who come to school not knowing the language. The 9th U.S. Circuit Court of Appeals will consider claims on Dec. 4 by state Superintendent of Public Instruction Tom Horne as well as Republican legislative leaders that the order by U.S. District Judge Raner Collins ignored evidence of the progress that has been made in programs for students who are not proficient in English. They want the appellate court to overturn a series of his rulings.

Oct. 11, 2007 Associated Press March deadline for state to up funding for English programs  A federal judge has set a March 4 deadline for the Legislature to increase funding for programs for students who are learning the English language. U.S. District Judge Raner C. Collins of Tucson has also said he will impose sanctions if the state fails to comply with his order.

Aug. 31, 2007 The Arizona Republic  State faults teachers of English learners  "The kids are taught by teachers who don't know English grammar and can't pronounce English words correctly. Last year, for example, a Mesa teacher stood in front of a class of language learners and announced, "Sometimes, you are not gonna know some." A teacher in Phoenix's Creighton Elementary District asked her kids, "If you have problems, to who are you going to ask?" A Casa Grande Elementary District teacher asked her kids to "read me first how it was before."

Aug. 27, 2007 Associated Press Judge asked to allow more time for changes in English instruction "TUCSON - Top Republican legislative leaders are asking a judge to give the state more time to make planned changes for programs for students learning English."

July 25, 2007 Arizona Republic LAWMAKERS BUCK CONTEMPT REQUEST OVER COURT ORDER  "In a motion filed in U.S. District Court this week, Senate President Tim Bee and Speaker of the House Jim Weiers argue that they are not subject to a contempt action in the long-running lawsuit over English-language learners. That's because the duty to act falls on the state in the case, which is called Flores vs. Arizona, and not on specific legislative leaders."

Arizona taxpayers have spent nearly $1.3 million on attorneys fighting court orders to do more to help students learn English. And in some cases the lawyers getting state funds are not even on the same side of the legal arguments.

Written closing arguments in the case, Flores vs. Arizona are due March 12 in U.S. District Court in Tucson. This comes after a trial that began the first week of the legislative session and ran more than a week."

Jan. 10, 2007 Capitol Media Services Parents offer to settle English-learner lawsuit Tim Hogan said Tuesday that he presented attorneys for both the Legislature and schools superintendent Tom Horne a deal to have the state put more money into educating these students.

Jan. 5, 2007 Associated Press Judge refuses to delay English-learner trial A federal judge on Friday refused to delay a scheduled trial in a nearly 15-year-old political and legal dispute over adequacy of Arizona school programs for students learning the English language.

Jan. 2, 2007 - Associated Press - Horne, lawmakers want delay in ELL case.  State Superintendent Tom Horne and Republican legislative leaders are asking for a delay in a scheduled mini-trial in a thorny education funding dispute now that a federal judge has refused to limit the case to only the adequacy of English Language Learning programs in one school district instead of statewide.
